1. About this policy

RocketAMS ("RocketAMS", "we", "us" or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, hold, use and disclose personal information, and how you can access and correct that information or make a complaint.

‍
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Where the European Union General Data Protection Regulation (GDPR) or the UK GDPR applies to our handling of your personal information, we also seek to comply with those laws, and the additional rights set out in the "Your rights" section below are available to you.

This policy applies to our website at https://rocketams.com.au/ (the "Website") and to the services we provide as an Amazon marketing and channel management agency (the "Services"). By using our Website or Services, you agree to the collection and use of your personal information in accordance with this policy.

2. What is personal information

Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not and whether it is recorded in a material form or not. Sensitive information is a subset of personal information (for example, health information, or information about your racial or ethnic origin) and attracts additional protections under the Privacy Act.

3. The personal information we collect

The kinds of personal information we collect and hold depend on your dealings with us. They generally include:

  • Contact and identity details: your name, business or job title, company name, email address, postal address and phone number.
  • Enquiry and engagement information: the content of your enquiries, proposals, correspondence, contracts and records of the Services we provide to you or your organisation.
  • Marketing information: your preferences for receiving marketing from us and your engagement with our emails and campaigns.
  • Website usage data: information collected automatically when you use our Website, such as your IP address, device and browser type, operating system, referring pages, the pages you view, and the date, time and duration of your visit.
  • Cookies and similar technologies: information collected through cookies, pixels, tags and analytics tools, as described in the "Cookies and tracking technologies" section below.

Sensitive information. We do not usually collect sensitive information. If we ever need to, we will only do so with your consent or where we are otherwise permitted or required by law.

4. How we collect personal information

We collect personal information in a number of ways, including:

  • directly from you, when you contact us, complete a form on our Website, subscribe to our communications, engage our Services, or correspond with us by email, phone or in person;
  • automatically, when you interact with our Website, through cookies and analytics tools;
  • from third parties, such as your organisation, our business partners, referrers, or publicly available sources, where it is reasonable and practicable to do so.

Where it is lawful and practicable, you can deal with us anonymously or using a pseudonym. In most cases, however, we need your contact details to respond to your enquiry or provide our Services.

5. Why we collect, hold, use and disclose personal information

We collect, hold, use and disclose personal information for purposes including:

  • providing, managing and improving our Services;
  • responding to your enquiries and requests;
  • managing our relationship with you and your organisation, including administering contracts, billing and account management;
  • sending you marketing communications, updates, insights and information about our Services (subject to the "Direct marketing" section below);
  • operating, maintaining, analysing and improving our Website;
  • conducting research, analytics and business development;
  • protecting the security and integrity of our systems and preventing fraud or misuse;
  • complying with our legal obligations and enforcing our legal rights.

Lawful bases (GDPR). Where the GDPR or UK GDPR applies, we rely on one or more of the following lawful bases to process your personal information: your consent; the performance of a contract with you or your organisation; our legitimate interests in operating and growing our business (balanced against your rights and interests); and compliance with a legal obligation. Where we rely on consent, you may withdraw it at any time.

6. Cookies and tracking technologies

We use cookies and similar technologies (such as pixels, tags and web beacons) to operate our Website, remember your preferences, understand how the Website is used, and measure and improve our marketing.

The categories we use include:

  • Essential cookies that are necessary for the Website to function.
  • Functionality cookies that remember your choices and preferences.
  • Analytics cookies that help us understand how visitors use the Website. We use analytics providers such as Google Analytics for this purpose.
  • Advertising cookies and pixels that help us deliver and measure relevant advertising. We use advertising and retargeting technologies such as those provided by Meta (Facebook), Google Ads and LinkedIn.

You can control or disable cookies through your browser settings, and you can opt out of many advertising cookies through industry tools such as the settings offered by the relevant platforms. If you disable cookies, some parts of the Website may not work as intended. Where required by law, we will seek your consent before setting non-essential cookies.

7. Who we disclose personal information to

We may disclose your personal information to:

  • Our team and personnel, including members of our team located in the Philippines who support the delivery of our Services;
  • Service providers and processors who help us run our business, including website hosting and IT providers, analytics providers, advertising and marketing platforms, and email marketing and customer relationship management (CRM) providers;
  • Professional advisers, such as our accountants, auditors and lawyers;
  • Our related entities, business partners and affiliates, where relevant to the purposes described in this policy;
  • Third parties in connection with a business transaction, such as a merger, acquisition, financing or sale of assets, in which case personal information may be among the assets transferred;
  • Law enforcement, regulators, courts and government agencies, where required or authorised by law, or where we reasonably believe disclosure is necessary to comply with the law, protect our rights or property, prevent or investigate wrongdoing, or protect the safety of any person.

We require our service providers to handle personal information consistently with this policy and applicable privacy laws, and only for the purposes for which we engage them.

8. Overseas disclosure

Some of the parties to whom we disclose personal information are located outside Australia. In particular, members of our team are located in the Philippines, and some of our service providers (for example cloud hosting, analytics, advertising and CRM platforms) may store or process personal information in the United States, the European Union and other countries.

Where we disclose personal information overseas, we take reasonable steps to ensure that the recipient handles it in accordance with the Australian Privacy Principles or an equivalent standard. Where the GDPR or UK GDPR applies, we rely on appropriate safeguards for international transfers, such as adequacy decisions or Standard Contractual Clauses, where required.

9. Direct marketing

We may send you marketing communications about our Services where you have requested them, where you are an existing client, or where we are otherwise permitted to do so. We handle direct marketing in accordance with the Australian Privacy Principles and the Spam Act 2003 (Cth).

Every marketing email we send includes an unsubscribe option, and you can opt out of receiving marketing from us at any time by using that option or by contacting us at privacy@rocketams.com.au. We will action your request promptly. You may still receive service-related or transactional communications after opting out of marketing.

10. Automated decision-making

We do not use computer programs to make decisions that produce legal effects concerning you, or that similarly significantly affect your rights or interests, without meaningful human involvement. If this changes, we will update this policy to describe the kinds of personal information used and the types of decisions made, consistent with the transparency requirements taking effect under the Privacy Act. Where the GDPR applies, you have the right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects, as described in the "Your rights" section.

11. How we hold and protect your personal information

We hold personal information in electronic and, where relevant, physical form. We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure, including through access controls, secure systems and the use of reputable service providers.

No method of transmission over the internet or method of electronic storage is completely secure, and while we strive to protect your personal information, we cannot guarantee its absolute security.

12. Data breaches

We comply with the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth). If we become aware of a data breach that is likely to result in serious harm to any individual whose personal information is involved, we will notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable, in accordance with the scheme. Where the GDPR applies, we will also notify the relevant supervisory authority and affected individuals where required.

13. How long we keep personal information

We keep personal information only for as long as necessary for the purposes described in this policy, including to provide our Services, and to satisfy our legal, accounting, tax and record-keeping obligations. When personal information is no longer required, we take reasonable steps to destroy or de-identify it.

14. Your rights

Under the Australian Privacy Principles, you may:

  • access the personal information we hold about you; and
  • request correction of that information if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading.

To make a request, contact us using the details in the "Contact us" section. We will respond within a reasonable period. There is no charge for making a request, although we may charge a reasonable fee for giving access in certain circumstances. We may need to verify your identity before actioning a request.

Additional rights (GDPR / UK GDPR). If the GDPR or UK GDPR applies to our handling of your personal information, you also have the right to: request erasure of your personal information; restrict or object to our processing; request data portability; withdraw consent where we rely on it; and lodge a complaint with a supervisory authority. You also have the right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects. We will honour these rights to the extent they apply.

15. How to make a complaint

If you have a concern or complaint about how we have handled your personal information, please contact us first at privacy@rocketams.com.au so we can try to resolve it. We will acknowledge your complaint and respond within a reasonable period.

If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992. If the GDPR or UK GDPR applies to you, you may also lodge a complaint with your local data protection supervisory authority.

16. Children's privacy

Our Website and Services are intended for businesses and are not directed at children. We do not knowingly collect personal information from children. If you believe we have collected personal information from a child, please contact us and we will take reasonable steps to delete it.

17. Third-party links

Our Website may contain links to third-party websites that we do not operate or control. This policy does not apply to those websites, and we are not responsible for their content or privacy practices. We encourage you to review the privacy policy of any website you visit.

18. Changes to this policy

We may update this policy from time to time to reflect changes in our practices or the law. We will post the updated policy on this page and revise the "Last updated" date above. Where changes are significant, we may also notify you by email or a prominent notice on our Website. We encourage you to review this policy periodically.
